1. Data Controller and Representative
EnderPOS Yazılım Sistemleri ("Company"), as the Data Controller in accordance with the Personal Data Protection Law No. 6698 ("KVKK"), pays utmost attention to the security of our customers' personal data. With this awareness, we carefully process, record, store, and transfer and/or disclose all personal data of all persons related to the Company and our customers in accordance with legal and ethical rules, within the limits permitted by legislation, limited to the purpose for which they are processed.
2. Collection, Processing and Purposes of Personal Data
Your personal data obtained by our Company may be collected verbally, in writing or electronically through automatic or non-automatic methods, offices, website, social media platforms, mobile applications, cameras and similar means, and may be processed within a lawful and ethical process and scope.
3. To Whom and For What Purpose Processed Personal Data May Be Transferred
Your personal data processed within the scope of the purposes described above may be shared with persons and/or organizations permitted by the Laws and secondary legislation of the Republic of Turkey, other third parties and legal authorities, the Company's main shareholder, direct/indirect domestic/foreign subsidiaries; service providers, partners, commercial partners, sellers/suppliers, domestic/foreign subcontractors and other third parties, in accordance with the basic principles stipulated in KVKK and within the framework of personal data processing conditions and purposes specified in Articles 8 and 9.
4. International Data Transfer
Your personal data may be transferred by our Company, by obtaining explicit consent in accordance with the principles stipulated in Article 4(2) of KVKK, or without obtaining explicit consent in the presence of the situations stipulated in Articles 5(2) and 6(3), subject to compliance with the rules in Article 9 of the Law, only to persons and organizations resident in foreign countries determined to have adequate protection by the Personal Data Protection Board, and for countries determined to have inadequate protection, limited to cases where data controllers in Turkey and the relevant foreign country commit in writing to adequate protection and the Board's permission is obtained.
5. Method and Legal Basis of Personal Data Collection
In accordance with the Personal Data Protection Law No. 6698 ("KVKK"), all kinds of information that serve to identify or make identifiable a real person are collected in line with the purposes stated above. Your personal data collected in this process may also be processed and transferred for the purposes stated in paragraphs (1) and (2) of this text, within the scope of personal data processing conditions and purposes specified in Articles 5 and 6 of KVKK.
6. Your Rights under Article 11 of KVKK as a Personal Data Owner
If you, as our customers and personal data owners, submit your requests regarding your rights to our Company through the methods regulated below in this Disclosure Statement, our Company will conclude the request free of charge as soon as possible and within 30 (thirty) days at the latest, depending on the nature of the request. Your rights under Article 11 of KVKK are as follows:
- - Learning whether personal data is processed,
- - Requesting information about processed personal data,
- - Learning the purpose of personal data processing and whether they are used in accordance with their purpose,
- - Knowing the third parties to whom personal data are transferred domestically or abroad,
- - Requesting correction of incomplete or inaccurate personal data and requesting notification of the correction to third parties to whom personal data have been transferred,
- - Requesting deletion or destruction of personal data when the reasons requiring processing have ceased to exist, despite being processed in accordance with KVKK, and requesting notification of this to third parties,
- - Objecting to a result against the person through analysis of processed data exclusively by automated systems,
- - Requesting compensation for damages caused by unlawful processing of personal data.
In accordance with Article 13(1) of KVKK, you can submit your request to exercise the above-mentioned rights to our Company in writing. No:80 D:204 Silifke / MERSİN in person, send it via notary, or through other methods specified in the KVKK Law.
